PB UMKU After NIB in Indonesia: When Supporting Licences Still Apply

Receiving an NIB does not automatically mean every licence needed for the business is complete. PB UMKU is a separate supporting-legality layer that can still apply where a product, facility, operational process or other business activity requires additional authorization at the operational or commercial stage.

Indonesia’s current overarching risk-based licensing framework is Government Regulation No. 28 of 2025, which replaced Government Regulation No. 5 of 2021.

PB UMKU After NIB Indonesia: The Short Answer

The NIB and PB UMKU answer different regulatory questions.

The NIB forms part of the core Business Licensing structure. Depending on the risk level, the core licensing package can be an NIB alone, an NIB plus a Standard Certificate or an NIB plus a Permit.

PB UMKU is different. It is supporting legality required for a business activity where an additional approval is needed for the operational or commercial stage.

Under Article 186 paragraph (5) of Minister of Investment and Downstream Industry/Head of BKPM Regulation No. 5 of 2025, a Business Licensing activity that requires supporting legality at the operational and/or commercial stage must also have the applicable PB UMKU.

That means NIB issued and all supporting approvals complete are not always the same status.

Core Business Licensing and PB UMKU Are Different

The easiest way to understand the system is to separate the two layers.

Core Business Licensing

Core Business Licensing answers the question: what legal instrument allows this business activity to exist and operate under its risk classification?

Depending on the risk level, that can involve:

  • NIB
  • NIB plus Standard Certificate
  • NIB plus Permit

The core document is determined by the risk classification of the business activity.

Supporting Legality Through PB UMKU

PB UMKU answers another question: does the business need an additional authorization to support a product, facility, technical function or commercial activity?

The same Article 221 states that where the operational and/or commercial stage requires PB UMKU, the business actor must hold the required PB UMKU.

This explains why two companies can both possess valid NIBs while only one needs a particular supporting approval.

When Does PB UMKU Apply?

PB UMKU does not apply merely because a company has an NIB. The trigger is the actual activity and whether supporting legality is required for that business at the operational or commercial stage.

A useful review starts with four questions:

  1. What is the exact KBLI?
  2. What product or service will actually be sold?
  3. What facility, equipment or operational function is used?
  4. Does the current OSS output identify a PB UMKU connected with that activity?

The answer should come from the live OSS requirements for the business, not from a generic list copied from another company.

The current OSS PB UMKU directory lists supporting licences across multiple sectors and displays related KBLI information for many entries.

That directory is useful because it shows why PB UMKU is activity-specific. A health-sector company, telecommunications business, food producer, industrial operator and tourism business can have very different supporting-legality requirements even though all may already hold an NIB.

What Can PB UMKU Support?

PB UMKU is broader than one type of operational permit.

Under Article 221, PB UMKU can support product circulation, operational feasibility, product or service standardization, or other requirements needed to facilitate business activities.

That gives businesses four practical categories to review.

PB UMKU functionPractical question
Product circulationDoes the product need a supporting authorization before distribution or sale?
Operational feasibilityDoes equipment, a facility or an operation require evidence that it is fit to operate?
Product/service standardizationDoes the product or service require a supporting standard, certification or approval?
Other operational supportDoes another sector-specific legality support the commercial activity?

The table is a decision aid, not a universal permit list. The exact document and competent authority depend on the sector and activity.

PB UMKU Is Linked to the Actual KBLI

The supporting licence analysis should begin with the registered business activity.

The PB UMKU application is activity-linked because Article 221 requires the business actor to submit the application through OSS by selecting the relevant business-activity KBLI.

This matters when a company has multiple activities. One KBLI may not require a particular PB UMKU, while another activity in the same company may create a supporting approval requirement.

Do not therefore ask only, “Does this company need PB UMKU?” Ask, “Which registered activity needs which supporting legality?”

That distinction is especially important when the company adds a new product, facility or business line after the original NIB was issued.

How the OSS PB UMKU Process Works

PB UMKU has its own OSS workflow.

OSS also maintains a dedicated PB UMKU application guide, reflecting that supporting licences are processed as a distinct workflow from the core Business Licensing document.

At a high level, the business selects the relevant activity and supporting licence in OSS, submits the required information and documents, and the application is routed to the authority with jurisdiction over that PB UMKU.

Under Article 222, OSS sends the selected PB UMKU application to the competent ministry, agency or regional authority, which then performs the applicable verification.

The actual supporting documents, technical review and approval conditions differ by PB UMKU. Businesses should therefore read the requirements shown for the exact permit rather than assuming the NIB documentation will be sufficient.

Does PB UMKU Always Come After NIB?

Not necessarily. The phrase PB UMKU after NIB is useful for explaining the difference between core and supporting licensing, but it should not be treated as an absolute chronology for every case.

That is why ‘after NIB’ should not be treated as an absolute timeline: Article 224 allows certain PB UMKU applications before the operational and/or commercial stage where facilities or infrastructure are needed beforehand.

The practical sequence can therefore depend on what the business needs to construct, install, test or prepare before commercial operations begin.

This is particularly relevant to businesses with technical facilities. A company may need to plan the supporting approval while preparing the site rather than waiting until the planned launch date.

Do Not Confuse PB UMKU With Every Sector Obligation

Another common mistake is treating every ongoing sector obligation as PB UMKU.

PB UMKU is a defined licensing category in the risk-based system. A company can also have tax, employment, environmental, reporting, product or other compliance obligations that are governed by separate rules.

The correct compliance map should therefore separate:

  • core Business Licensing
  • PB UMKU
  • basic requirements
  • sector-specific operating obligations
  • periodic reporting and maintenance requirements

This avoids both under-licensing and unnecessary applications.

What Happens if the Required PB UMKU Is Missing?

If an activity legally requires a supporting licence, the company should not assume that a valid NIB cures the missing PB UMKU.

Compliance continues after issuance because Article 364 provides for administrative sanctions where supervision finds violations of basic requirements, Business Licensing or PB UMKU.

The official BKPM legal database lists Minister of Investment and Downstream Industry/Head of BKPM Regulation No. 5 of 2025 as in force and records that it repealed BKPM Regulations Nos. 3, 4 and 5 of 2021.

The safest approach is to identify the supporting approval before the relevant product, facility or commercial operation is launched.

Post-NIB PB UMKU Checklist

Use this checklist when the NIB or core Business Licensing has already been issued but the business is preparing to operate or expand.

Review itemQuestion
KBLIIs every real activity correctly registered?
Core Business LicensingIs the NIB, Standard Certificate or Permit complete for that activity?
OSS PB UMKU outputDoes OSS show supporting licences linked to the KBLI?
ProductDoes commercial distribution require a supporting authorization?
Facility/equipmentDoes operation require a feasibility or technical approval?
StandardsDoes the product or service require certification or standardization?
AuthorityWhich ministry, agency or regional authority verifies the PB UMKU?
TimingMust the supporting licence be completed before commercial operation or during preparation?
New activitiesHas the company added a new service, product, location or facility since NIB issuance?
RecordsCan the business produce the current PB UMKU and supporting evidence during supervision?

The objective is not to collect every licence visible in OSS. It is to identify the supporting legality connected with the company’s actual activity and complete it at the correct stage.

Jakarta Legal ID’s NIB and OSS registration guide provides broader context on the core licensing process before this supporting-licence review.

For businesses that need implementation support, Jakarta Legal ID currently lists PT PMDN/PMA setup, NIB OSS and business licensing within its service scope.

Conclusion

PB UMKU after NIB is not an extra permit that every company must automatically obtain. It is a supporting-legality category that becomes relevant when the actual business activity requires additional authorization for products, operational feasibility, standardization or another supporting function.

The NIB or other core Business Licensing remains the starting point, but it does not replace PB UMKU where the applicable rules make that supporting licence mandatory.

Review the exact KBLI, live OSS PB UMKU options and operating model before launch or expansion. The most reliable compliance question is not simply “Do we have an NIB?” but “Does every product, facility and commercial activity have the supporting legality required for it?”

FAQ – PB UMKU After NIB Indonesia

Is PB UMKU the same as an NIB?

No. The NIB forms part of the core Business Licensing structure, while PB UMKU is supporting legality required for certain products, facilities, standards or operational and commercial activities.

Does every company need PB UMKU after receiving an NIB?

No. PB UMKU depends on the exact KBLI, sector and business activity. The live OSS requirements should be checked for each activity.

What can PB UMKU be used for?

The current OSS implementing regulation identifies functions including product circulation, operational feasibility, product or service standardization and other supporting requirements for smooth business activity.

How do I know which PB UMKU applies to my company?

Start with the correct KBLI and review the PB UMKU options generated or listed for that activity in OSS. Do not rely solely on a generic industry checklist.

Does PB UMKU always have to be processed only after the NIB?

No. Certain PB UMKU can be applied for before the operational or commercial stage where facilities or infrastructure are needed beforehand.

Can a valid NIB replace a required PB UMKU?

No. Where supporting legality is mandatory for the operational or commercial stage, the relevant PB UMKU must be held in addition to the core Business Licensing.
